Abstract |
The article discusses the need for a
response to the stages of criminal proceedings in cases where the
parties abuse their subjective rights. At the moment, there are no restrictions
and ways to prevent abuse of rights by all participants in the criminal justice
and responses to the abuse happened. The author offers a means of combating
abuse of rights, include countermeasures, such as strengthening the quality of
departmental and judicial control. Quality department, judicial supervision and
the prosecutor’s supervision will help to identify the facts of abuse of
rights, and provide an appropriate response to the identified facts in accordance
with the opportunities offered by the Criminal Procedure Law. |
