Abstract |
This article is devoted to the
theory of criminal procedure relationship. The paper identified the general and
specific features of the procedural relationships in criminal proceedings, on the
basis of which the author constructed his own definition of the concept of «criminal
procedure relation.» Among the common features of procedural interactions
are indicated, in particular, legal form, multiplicity, two-sidedness. Among
the specific features also highlighted the subjectivity, dynamic, dual legal
nature. However, the article draws attention to the interaction between criminal
law and procedure, to the social relations, regulated by them with the criterion
of their difference. |
