Abstract |
The article considers the problem of
reforming judicial system of the Russian Federation as a condition of
effective establishment and development of the judicial constitutionalism. It
analyses main conceptual approaches to ensure uniformity of judicial practice,
including elaboration of unified interpretation of legal norms by the plenary assembly
of the Supreme courts, the stabilization of statutory and regulatory range,
realization of the idea «of the Supreme judicial presence». Taking into account the
objective complexity of a number of factors, predetermined by the process of
active reforming in national political and legal institutions, there is an argument
about the validity of the concept of formation of uniform Supreme judicial
authority of the Russian Federation. |
