Abstract

The article considers problematic issues of legal confirmation of a concept and components of public (state and municipal) ownership. The author determines specific character of a state as a member of property relations. A special status of a state and its orientation on execution of socially important functions does not allow to control its participation in property relations like private owners and therefore to be limited in such relations by a private law regulation. Thereby the author suggests an argument of a necessity of legal confirmation of a concept of public (state and municipal) property and its components as well as setting up a special public regime of the mentioned property.
