Abstract |
The author of the article analyzes the objective
aspect of falsification of the decision of the
general meeting of shareholders or the decision of
the Board of Directors (Supervisory Board) of
Business Company (part 1 of article 1855 of the
Criminal Code of the Russian Federation). The
research is made both on the basis of norms of
criminal law, and on the basis of norms of
regulatory legal acts of other branches of law (civil
and financial law). The analysis enables to solve
some questions arising from legal practice in
connection with qualification of falsification of
the decision of the general meeting of shareholders
or the decision of the Board of Directors (Supervisory
Board) of Business Company. |
