Abstract

The article considers one of the key aspects of the demarcation of the administrative and criminal liability for violations of the law of the Russian Federation on the state secret: based on the analysis of the various approaches available to the scientific and educational literature, as well as the provisions of the current legislation on civil and criminal liability investigated regarding the presence of signs of public danger in administrative offenses related to violation of the legislator of the Russian Federation on the state secret. It is concluded that such administrative offenses have a sign of social harm, but they do not have the characteristic of public danger.
