Abstract |
The article considers the issues of
independence of an expert in civil and arbitration proceedings and certain
provisions of the project of the Federal Law ‘On judicial and expert activity in
the Russian Federation’. The author carries out an opinion test of the
scientists representing the judicial and expert
activity in the USA. The author also draws
the conclusion on the existence of sufficient guaranties of independence in the
activity of forensic experts stated by the government of the Russian Federation.
The issues of additional guaranties can be considers only in accordance with
the current legislation. |
