Abstract |
Theoretical and practical aspects of the analytic
activity, underlying the process of forming
investigator’s decision are examined by the analysis
of theoretical and legal positions, the views of
representatives of criminal procedure science and
the norms of the Criminal Procedure Code of the
Russian Federation. The author concludes that a
universal method, being the algorithm of
investigative activities, is a dialectical method,
the features of which can be classified regarding
the investigation process as a whole and the
activities of an investigator in particular. In the
course of any investigation, the investigator not
only analyzes the facts of the case, in the process
of making a decision he operates within “perception/research-analysis-assessment”
and follows the laws of the system analysis. |
