Abstract

This article focuses on the peculiarities of the new Code of Criminal Procedure of the Republic of Kazakhstan in terms of regulating the key provisions and institutions of this branch of law. It analyses the advantages of criminal law innovations concerning the arranging and conducting the court proceeding, including arrangement of plea bargains. The author underlines the necessity to take the judicial discretion into account in cases when plea bargain is being arranged with a prosecutor, and outlines a number of questions that have been aroused concerning the mechanism of plea bargaining.
