Abstract |
The author pays attention on the urgent character of
the scientific study of the civil and legal
principles, as well as the necessity of using new
methodological approaches for studying the
abovementioned legal category. The author analyzes
the legal nature of civil principles and considers
the expressions of the aforementioned category in
legislation. The author also determines the role of
civil principles in the enforcement mechanism.
Moreover, the article dwells on the feasibility of
non-normative principles i.e. not consolidated in
current legislation. |
