Abstract |
The article is devoted to the study of certain
peculiarities of insurance agreements. The insurance
agreement is considered as a casual bilateral deal
independent on the number of participating parties.
The author proves that an insurance agreement is
consensual, compensated, and mutual in all cases.
The author also gives arguments for the primary
importance of the event insured for the
establishment of the insurance relationships. It is
stated that the event insured does not always meet
the characteristics of unexpectedness and
harmfulness which proves the fact that the insurance
agreement is not always aleatory. The viewpoint of
insurance agreement as a contingent transaction is
being argued. The scope of coverage is being
characterized. |
