Abstract

The article considers the matters of modern constitutional development in Russia from the perspective of the theory of risks, and determines the circumstances which characterize the situation of constitutional risk. The article also define the notion of situation of constitutional risk and analyze the issues of reforming of the Constitution of the Russian Federation and the dynamics of the current legal system, as well as the political and legal factors which have an impact on these processes. The author studies the disadvantages of the contents of the Constitution of the Russian Federation as well as the peculiarities of its realization in the sphere of political practice. The author also characterizes the problems of the  effectiveness of the state, matters of trust to the state authority and matters of existence of conflictive environment in relations of the civil society and state, as well as the risks of implementing a constitutional reform in a revolutionary way.
