Abstract

The article analyzes trends in penal policy in the course of sentence imposition depending on the category of crime. Depending on the applicability of a form of criminal punishment and the frequency of use of lenient or strict punishment it is decided on either mitigation or reinforcement of the criminal repression by the law enforcer for the commission of criminal acts. By analyzing the ratio of applicability of different types of criminal penalties the author was able evaluate the real effectiveness of a particular form of criminal punishment, the actual realization of the punitive potential pledged in it, variability of judicial practice in criminal sentence imposition, and the implementation of the principle of individualization of criminal punishment.
