Abstract

The article is devoted to the problems related to the late familiarization of the suspect, the accused, and his defender with a resolution on the appointment of a court examination. The article describes the legal provisions on this question and formulates in the terms and definitions of the Constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation. The author comes to the conclusion that the establishment of legal provisions of the Supreme Court of the Russian Federation contributes to the proper practice of the criminal procedural law and eliminates the double interpretation of the provisions of article 198 of the Criminal Procedural Code of the Russian Federation
