Abstract |
The article is devoted to
peculiarities of the mechanism of implementation of judicial power by judicial law.
The author justifies the thesis of the fact that the concept of judicial law
presupposes the establishment of science of judicial law, as well as the complex branch
of law on the basis of unification of those provisions which unify the issues of
judicial protection of constitutional human rights and freedoms. The author
comes to a conclusion that the concept of ‘judicial law’ presupposes the
combination of norms of constitutional, arbitration, administrative, civil and criminal
and procedural law. Within the framework of such an integral branch of law as
judicial law there should be judicial protection of rights and freedoms as
a real superiority of secure provision of the mechanism of judicial power. |
