Abstract

The article discusses certain aspects of legal regulation at the constitutional level and in the norms of the current Russian legislation implementing the constitutional right to freedom of assembly. The author analyzes the decision of the Constitutional Court of the Russian Federation and the European Court of Human Rights relating to the protection of the constitutional right to freedom of assembly.

Certain attention is drawn to administrative responsibility for committed administrative offenses related to the violation of the order of organizing or carrying out meetings, demonstrations, marches and pickets. The author draws conclusions about excessive restriction of the constitutional right for freedom of assembly under the current Russian legislation, as well as the transfer of significant powers to the legal regulation of the implementation of the right to the regional level of government.
