The problems of formation and development of the theory of constitutional and legal risks are considered in the article, questions of defining the scope and the content of risk category in Russian constitutional law science and also characteristics of constitutional legal risks are analyzed, their peculiarities, social importance, dependence on concrete conditions of existence of Russian society and the state, special nature of their origin, their relation to legal, economic, political, cultural and other social acquisition and loss are defined, the collision of assessment, the indetermination of constitutional and legal risks, and their axioms are characterized in the article.
