This article examines genesis and evolution of the institution of private property, its relationship with the political, economic and social relations in the society. Historically determined causes of institutional crisis of propertyrelations in Russia are revealed. Social economic and managerial factors of economic reforms influencing the formation of illegitimate property and making obstacles to social development and modernization of the country are stated. Characteristic of contradictions that have a negative influence on the formationof criminological healthy market economy relations is given. Mechanism to influence of illegitimate ownership on determination of raiding is revealed. The necessity of criminological readjustment of property relations is proved, ways of its legitimacy are given.
