Abstract

The article analyzes the question of criminal-legal qualification illegal sale of narcotics with the partial realization of criminal intent. Recent changes in judicial interpretation of the rules on illegal sale of narcotics given by the Resolution of the Plenum of the RF Supreme Court radically changed the position of the highest court instance on question of qualification preparation for illegal sale and attempt on illegal sale. The author analyzes the new approach RF Supreme Court the qualification of «controlled sales».
