Abstract |
The article deals with the detailed analysis of the
category “protection of subjective civil rights”,
sets forth peculiar features of modern theoretical
law understanding of basic essential characteristics
of a civil offence and protection of subjective
civil rights, for ex. succession legal bond. The
author draws a parallel between the similar
provisions of a foreign law and order. The paper is
rich in practically applied examples of protection (violation)
of subjective successors’ rights, it also
illustrates theoretical complicated issues and ways
of realization of basic protection successors’
rights mechanisms. It indicates that the
interpretation of the category “protection of
subjective civil rights” (for ex. successor’ rights)
guarantees proper legal acts enforcement along with
legality and safety for subjects to exercise the
rights. |
