Abstract |
The article is devoted to the analysis of
organizational-legal forms of nonprofit
organizations taking into account the upcoming
changes in the civil legislation of the Russian
Federation. In development of the provisions of
paragraph 3 of article 50 of the Civil Code of the
Russian Federation, the author introduces a new
design of organizationallegal forms of legal
entities to the legislator — «the state social fund».
Under the «state social fund» the author proposes
the recognition of a non-profit organization that
was created by the Russian Federation to exercise
state functions in order to ensure realization of
the rights of citizens to obligatory social
insurance and management of the budget means of the
state social fund of the Russian Federation.
The author offers to convert the Pension Fund of the
Russian Federation, a state institution into a legal
entity of a special organizational-legal form — «the
State Social Fund». In addition, the author suggests
that a new legal form of legal entities be applied
to the social insurance fund of the Russian
Federation, Federal fund of obligatory medical
insurance and territorial bodies of the Pension Fund
of the Russian Federation and the social insurance
fund of the Russian Federation, established at the
level of subjects of the Russian Federation and
having the rights of legal entities, territorial
funds of compulsory medical insurance. |
