Abstract

The article considers certain problems associated with the implementation of the principle of prohibition of involuntary labor in the Russian labor legislation. In particular, it explores issues of classification of involuntary labor as work performance without proper payment or in the conditions of the absence of individual and collective protection. The article draws attention to the relationship between the concepts of ‘involuntary labour’ and ‘compulsory labour’. The author also mentions controversies of certain provisions of the Labor Code of the Russian Federation in relation to the use of compulsory labor under extraordinary circumstances, such as at temporary transfer of the employee to another job. The article contains proposals for amendments in the labor legislation, namely in the Articles 4 and 72.2 of the Labour Code of the Russian Federation.
