Abstract

The article discusses the mechanism of legal guarantees to ensure adequate standard of living. The author analyzes legal aspect of adequate standard of living. Under the aforementioned term the author implies the right for adequate food or freedom from hunger; rental housing, as well as the right to be free from poverty and social exclusion. From the meaning of articles of the law on the subsistence minimum the author concludes that the right for minimum living conditions guaranteed by the state is implied. The analysis of the international legislation is carried out on the basis of the author comes to the conclusion that the Russian legislation is in urgent need of systematization and introduction of new instruments in terms of social security. However, one should remember that international instruments can not worsen the existing conditions for the provision of various types of social security. The author offers to amend the modification of the existing social legislation, as well as to introduce certain basic law on social security and to establish the minimum social standard and the minimum consumer budget.
