Abstract |
Article is devoted to the problem of
legal definition of concepts of «control» and «supervision»
connected with mixture of the specified concepts of the right is considered. In
article the main signs of control and supervision in communication with what the
conclusion is drawn on possibility of
differentiation of concepts of «control» and «supervision». By results of the conducted research
the conclusion that to possible decisions arisen collisions inclusion of
concepts of «control» and «supervision» in the Federal law of 26.12.2008 No.
294-FZ «About protection of the rights of legal entities and individual
entrepreneurs at implementation of the state control (supervision) and municipal control»
as separate, independent functions of the state bodies differentiated on the
above-mentioned bases can be is drawn. |
