Abstract |
The article analyzes the positions
of legal scholars about the content of prudential supervision. It expressed
considerable disagreement and discussion of this notion, borrowed from
foreign and international practice, despite the existence of a legal consolidation
of similar sounding terms in the legislation of the Russian Federation. It noted the
lack of clear criteria for the analysis of this concept, and also has the problem
definition of «prudential supervision», based on the ambiguity of understanding of
the terms «supervision» and «control». The conclusion about the need for
in-depth studies of this phenomenon for the adaptation of the legal term for its
use in the domestic law. |
