Abstract

The paper reveals the concept of a restriction. Constitutional and unconstitutional restrictions of human rights in general and restrictions of academic freedom in particular are examined. The options of correlation of human rights and their limitation are formulated. The constitutional justification and aims, in accordance to which the use of restrictions is legitimate, are specified. According to the conducted research the academic freedom refers to the category of constitutional rights, to which restrictions can be applied. The paper also considers the ways of realization of acceptable and unacceptable restrictions. The limits of permissible restrictions for human rights and academic freedom, as well as measures of evaluating permissible limitations of rights based on the conducted analysis of the theory and court practice are specified.
