Abstract

The author attempts to give criminal study of the subject and the mechanism of criminal and legal regulation taking into account the tendencies of the modern criminal policy concerning the revision of the established within the criminal and legal theory and law-enforcement practice approaches to defining the social danger of different acts. The author analyses from logical and gnoseological and special juridical views the most important criminal and legal phenomena, however they are not separated from each other, but are being analyzed as interconnected phenomena forming the single mechanism of criminal and legal regulation which has to be improved using a modern paradigm approach.
