Abstract

This article describes a totally new type of the relief from criminal responsibility stipulated by the Criminal Code of the Republic of Kazakhstan as of 2014 which has come into force since January 01, 2015. Such relief is due to the implementation of the plea bargain arranged between the prosecutor and the defendant, suspected, accused or convicted person. Furthermore, when the convicted person is arranging such plea bargain, the other party of such bargain is either Prosecutor General of the Republic of Kazakhstan or its deputy. This phenomenon is of interdisciplinary nature as the plea bargaining arrangement is to be governed by the regulations of the criminal procedure law and is a legislative innovation.
