Abstract

In the article the concept of functional check is investigated; grounds, purposes, and terms of its implementation in respect of the staff of the bodies of internal affairs are considered; procedural ways of establishing facts of disciplinary offenses are revealed. The author pays special attention to such procedural action as a request for explanation from the person in respect of whom the functional check is carried out. The author notes the importance of explanations from other persons which are either direct witnesses of the disciplinary offense or are not but able to give information on the circumstances of the offense. Suggestions on the improvement of the legislation which regulates functional checks during the implementation of disciplinary proceeding in bodies of internal affairs are made.
