Abstract |
In the article the author considers
measures of protection in Russian jurisprudence. Peculiarities which characterize the
given category of measures are also analyzed. The classification of
characteristics of measures of protection is considered in the article. The
comparison of characteristics of protection measures and of measures of legal
responsibility is discussed as a separate issue. The distinction between
measures of protection and measures of legal responsibility is based on the
following distinctive features: consolidation in statutory acts; foundations for
implementation; presence or absence of punitory function; the presence or absence of
conviction. The author gives the definition of protection measures on
the basis of the analysis. |
