Abstract |
The article reveals the modern model of a state
which was developed at
doctrinal level and received its consolidation on
constitutional level. The ideal
of the modern state is characterized by being legal
and social. Power of such
a state is depersonified, i.e. the only sovereign is
the people. The state can
be effective only on condition of the use of checks
and balances mechanisms
which are represented by the system of separation of
powers. The government
is always consolidated in its main manifestations:
legislations, enforcement of
the right, and justice. It can’t belong to a single
person or a single governmental
body, otherwise not only conditions for
antidemocratic totalitarian regime
appear, but also in this case the state loses its
public ground and becomes
incapable of solving problems it faces. The modern
Russian state is federative,
i.e. its sovereign is the multinational people of
the Russian Federation, and its
constituent units have the state and legal nature. |
