Abstract

In article reveals intrinsic features of one of the measures of the mechanism of protection of public interests in the contract system of the Russian Federation — on incorporation in the register of unconscientious information providers on parties of procurement transactions. In the course of the study this measure corresponds to such legal categories as protection, coercion, and responsibility as a result of what the conclusion that the measure of incorporation in the register of unconscientious information providers on parties of procurement transactions is a measure of legal responsibility is drawn. During search of the features referring this measure to the abovementioned category the author analyzes the administrative and judicial practice of its realization in the course of which problems with legal certainty of understanding and implementation of the aforementioned measure which, in its turn, is connected with the uncertainty concerning its branch appurtenance. The author draws the conclusion about the need of further studying and improvement of regulation of this measure of responsibility within administrative branch of law.
