Abstract

The article analyzes domestic criminal law and consider item “o”, Part 1, Article 63 of the Criminal Code of the Russian Federation, namely commission of intentional crimes by internal affairs officer as aggravating circumstances. In author’s opinion, this provision violates the constitutional principle of the equality of citizens before the law to get an official status. The author also analyzes the decree of the Constitutional Court of the Russian Federation as of N1623 4/4/2011-o-o on request of the Labytnangsky City Court of Yamal-Nenets Autonomous District on constitutionality test of item “o”, article 63 of the Criminal Code of the Russian Federation.
