Abstract

The present article considers problems arising in the activity of defenselawyers while providing a suspect with complete legal assistance; considers procedural legal guarantees of defense powers during the pretrial investigation; gives assessment of an investigator’s activity as a participant of the criminal proceedings who observes rights and obligations execution during a case proceeding; discovers the existing problems and suggests ways of their solving. An investigator should not only explain the rights of a suspect, or a defendant,but also create conditions ensuring their possible execution. Wherefore the author gives recommendations on amending the current legislation of the Russian Federation in the Criminal Procedural Code.
