Abstract

The incentives in the criminal procedure activity is examined with the help of the analysis of theoretical and legal positions, the views of representatives of criminal procedure science, the norms of the Code of Criminal Procedure of the Russian Federation. Encouragement is considered as a process of influencing the state of mind and consciousness of certain participants in the criminal process by the embodied in the Russian Code of Criminal Procedure powers of officials, aimed at strengthening the motivation of conduct and associated with the realization of legal rights. The author notes that incentives in the criminal process can be both positive (criminal procedure encouragement) and negative (possible imposition of criminal procedure responsibility).
