Abstract

The paper provides the analysis of such concepts as “cooperation” and “competition” between two levels of legal norms (international and national), “precedents” of the European Court of Human Rights, “principle of subsidiarity” in the system of international legal and state legal (national legal) regulation. The author examines the interaction of two main legal systems in the Constitution of the Russian Federation, practice of distinguishing the jurisdiction of international and state (national) courts of justice, the impact of the developed by the European Court standards of justice on the practice of their realization, and their further development by the Constitutional Court of the Russian Federation.
