Abstract

The article considers the lawful restriction of rights and freedoms of man and citizen of the Russian Federation. The distinction between the legal limitation of rights and freedoms and the actual denial is shown. The idea that restrictions should be imposed by lawmakers not randomly, but on the basis of the Constitution and the incorporated in the Constitution principles of equity, equality and proportionality is proved. International documents regarding the examined issue, Russian laws and decisions of the Constitutional Court of the Russian Federation are analyzed. The examples of limitation of human and civil rights and freedoms in foreign countries are given. The author draws a conclusion that despite a variety of scientific views, the purpose of the state is consolidation and development of human and civil rights and freedoms as a value priority and a fundamental idea conveyed in the Constitution of the Russian Federation.
