Abstract

The author considers the administrative prejudice as an institution known to the Russian Criminal Law, and prospects and possibilities of its application in the current legislation, including libel cases. The idea about introduction of administrative prejudice to Article 1281 of the Criminal Code on liability for libel without aggravating circumstances is justified. The author conducts the historical and legal analysis of the institution of administrative prejudice. Different opinions of scholars regarding the studied institution are examined. Article 188 of the Criminal Code of the Republic of Belarus and Article 139 of the Criminal Code of the Republic of Uzbekistan which establish criminal responsibility for defamation in the aforesaid countries serve as examples of the administrative prejudice use.
